Your Agreement With Us
Welcome to Nude Beach. This site is operated by SuperCritter, LLC ("Nude Beach", "we", "us"). By browsing this site or placing an order, you agree to these terms. If you do not agree, please do not use the site.
Nude Beach is a beach-lifestyle apparel and accessories brand. NUDE BEACH® is a registered trademark of SuperCritter, LLC (U.S. Reg. No. 7594401, Class 025). You can contact us any time at hello@nudebeachoriginal.com.
Placing an order is an offer to buy. We accept it when we send your order confirmation. We may decline or cancel an order, before or after confirmation, if an item is unavailable, if there is an error in the listing, or if we suspect fraud or a breach of these terms. If we cancel an order you have already paid for, we refund it in full.
Our products are printed for you after you order. Nothing sits in a warehouse waiting. This is why production takes a few days before anything ships, and why we cannot accept change-of-mind returns. See our Shipping Policy and Refund Policy for detail.
Prices are in US dollars and may change at any time before you order. Taxes and shipping are calculated at checkout. If a product is listed at an obviously incorrect price, we may cancel the order and refund you in full, even if you have already received a confirmation.
Custom Items and Intellectual Property
Some products let you add your own text. Because a personalised item cannot be resold, it is made only after you order it and it is not returnable except where it arrives damaged, defective, or different from what you ordered.
You are responsible for the text you submit, and you confirm you have the right to use it. We may refuse or cancel any personalisation that infringes anyone's trademark, copyright or other rights; is unlawful, hateful, harassing, obscene or sexually explicit; identifies or targets another person without their consent; or that we reasonably consider damaging to the Nude Beach brand. Please check your spelling, as we print the text exactly as you submit it and a typo you supplied is not a defect.
The Nude Beach name, the circular seal logo, site content, product designs and photography are owned by SuperCritter, LLC or used with permission. Buying a product does not transfer any rights in them. You may not reproduce our designs, use NUDE BEACH® as a mark for your own goods, or use our imagery commercially without written permission.
Please do not interfere with the site or its security, attempt to access accounts or data that are not yours, scrape or harvest content by automated means, or use the site unlawfully. If you create an account, keep your credentials secure and tell us promptly at hello@nudebeachoriginal.com if you believe it has been compromised.
Liability, Governing Law and Contact
The site and its content are provided "as is". We do not warrant that the site will be uninterrupted or error free, and colours may vary between screens and printed garments.
To the fullest extent permitted by law, our total liability arising out of or relating to any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential damages, or for lost profits. Nothing in these terms limits liability that cannot be limited by law, including for fraud, or your rights under applicable consumer protection law.
These terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Kansas.
